Understanding the difference between a contract, also known as an agreement, and a deed.
An agreement, also known as a contract, is formed when:
- There is an offer and an acceptance (for example, I offer to sell you my dog, and you agree to pay me $3000 for it);
- The parties demonstrate a clear intention to create legal relations, and
- The parties do something in exchange for an offer. This is known as consideration. For example, if I sell you my dog for the offer price, then in return, you will allow me to have one puppy of my choice for free from her first litter in the future
- The major difference between a deed and an agreement lies in whether there is any consideration for the promise. For example, if you are selling an adult dog in exchange for money, then you will need an agreement. However, if you are merely providing the dog for nothing in return, you may need a deed.

Filing Your Agreement/Contracts/Deed. You can choose to have your contract stamped by the relevant State Revenue Titles offices. Please note that the costs in the table above do not include fees for court agreements prepared for filing or any filing costs. The administration will provide separate cost estimates based on the court fees.
